Oxnard Pedestrian Accident La Based on statistics about 80,000 pedestrians are injured every year in the United States–about 5,000 of these injuries are fatal.  California seems to have the highest number of pedestrian fatalities. About 700 pedestrians died in motor vehicle accidents in California in 2014. Pedestrian deaths ratio in California is about 23% of all motor vehicle fatalities: tragically, it is about 100% higher than the national average, which is about 11%.  Apparently, California’s high death ratio is due to its congested roads, bad or nonexistent walks and insufficient crossing signals.

There are many other reasons for the high death ratio amongst pedestrians. Here are a few of the main factors: 

–Pedestrians have no protective shields, and they are totally vulnerable—subject to grave injuries—when vehicles, weighing thousands of pounds of moving metals, hit them. 

–Other most prevalent causes of pedestrian injuries and death are drivers’ distractions due to texting, talking, putting on makeup while driving, eating, drinking, making an improper turn, improper speed, rolling on a stop sign rather than stopping and looking at both sides of the road prior to turning, and so on.

Although everyone sharing the roads has a duty of reasonable care, the courts in California have frequently recognized that the danger posed by motor vehicles is much greater than that of pedestrians. Therefore, drivers are held to a higher standard of reasonable care. This duty heightens even more, where Children are frequently present, such as school zones.  
For instance, California Vehicle Code Section 19150 mandates that drivers must yield the right-of-way to pedestrians in crosswalks.  Even if pedestrians are outside a crosswalk, drivers have a higher duty of care to look out for them. California Vehicle Code 21951 forbids other drivers from overtaking or passing stopped vehicles, which are waiting for pedestrians to cross the intersections.
